Under the Māori Commercial Aquaculture Claims Settlement Act 2004, the Crown has an “aquaculture settlement” obligation to regional groups of iwi, based on regional council coastal boundaries.
This requires the Crown to provide iwi, through Te Ohu Kaimoana Settlement Trustee Ltd, with assets representative of 20 percent of anticipated commercial aquaculture space growth.
Critical to delivering this settlement obligation is the requirement that the Crown accurately value marine aquaculture space across New Zealand.
The Crown’s obligations are determined and settled prospectively, based on forecasts of anticipated aquaculture space growth over an agreed period (usually 20 years); and discounted cash flow valuation models that determine the value of that growth.
The aquaculture settlement must be maintained on an ongoing basis, requiring the Crown to reassess growth forecasts and settlement values at five yearly intervals.
We require models to value marine farm space for each of the relevant aquaculture species (at this point these are mussels, oysters and salmon ), their farming methods (inshore or open ocean as applicable), within each region.
