Whangarei District Council (Council) is going to the market for Independent Planning Commissioner panel members to hear, recommend and decide on matters under the Resource Management Act 1991 (‘RMA’) and other relevant resource management legislation. The process will be an open market process (Request for Proposal (RFP)).
Historically, Whangarei District Council has had a panel of Independent Planning Commissioners appointed to hear, recommend and decide on matters under the RMA and other and other relevant resource management legislation. The panel was last reviewed in 2020 and the appointed Independent Planning Commissioners signed contracts of service for a period of five years.
Having a panel of Independent Planning Commissioners ensures that commissioners with the relevant and requisite skills and experience are available as and when required to hear and determine matters requiring a decision or recommendation under the RMA or related legislation. Such matters would include but are not limited to decisions on Resource Consent Applications and Notices of Requirement and recommendations on Council initiated and private plan changes to the Whangarei District Plan.
It is intended that successful members of the Panel are used for commissioner engagements for Council unless:
• Certain specialist skills and resources are required for a hearing that are beyond the skills that the appointed Panel members hold;
• There is a conflict of interest that preclude Panel members from undertaking the work; or
• There are no Commissioners available within the Panel to enable a hearing to be held within required statutory timeframes; or
• Use of Councillor that is an accredited RMA Hearing Commissioner is appropriate to make the determination, and available to do so.
