We need representative data from already-completed remediation exercises to contribute to the design of a statutory estimated remediation methodology for employers to address underpayments from non-compliance under the Holidays Act 2003. We will need the supplier to:
• Undertake detailed analysis of the remediation outcomes shown in the data (e.g. determining what percentage of employees’ gross earnings per year had been underpaid, types of non-compliance under the Holidays Act, and for different employee types). The purpose here would be to construct proxies, drawn from the data, for what “reasonable compensation” could be in different scenarios.
• Recommend a potential estimation methodology to satisfy the requirements of the Employment Leave Bill. This final aspect of the project could be provided as a 'high level outline' in the first instance (with the potential for further, more detailed work to be commissioned at a later date).
