Overview

Ara Poutama Aotearoa, Department of Corrections (Corrections) is seeking responses to a RFP for Alcohol and Other Drug Testing Services in the community to the AS/NZS standard. This service is for people under Corrections management, not staff and must be delivered nationwide. Providers who wish to attend the Provider Briefing session on Thursday 24 September at 1pm on Microsoft Teams should register via email to tenders@corrections.govt.nz.

This is a national contract that will run for a term of three years with a right of renewal of two years (3 + 2). We are not releasing the draft contract straight away but note that this will be uploaded in due course. The contract will be based on a GMC Services but will have some Departures, including the need to make changes to fulfil our obligations under the Privacy Act. The insurance and liability caps are as follows:

Insurance
The Supplier must have the following minimum levels of insurance, taken out with a reputable insurer (being an insurer who, from the Start Date to the End Date, maintains a rating of A+ or more as determined by Standard and Poor’s):
1. Public liability insurance of $1,000,000 for any one event.
2. Professional indemnity insurance of $1,000,000 for any one claim and $8,000,000 in the aggregate for all claims in the insurance policy period.
3. Statutory liability insurance of $ 1,000,000 for any one claim and in the aggregate for all claims.
4. Third party motor vehicle insurance of $ 10,000,000 for any one accident.

Liability
Limited Liability: Each Party’s liability to the other Party (whether in contract, tort including negligence, or otherwise) under or in connection with this Contract:
a. will not exceed:
i. for the Buyer – $100,000, and
ii. for the Supplier – $1,000,000 in the annual aggregate
