This exemption under rule 14.9.d, additional goods and services to the open-advertising requirement is on the basis that:
1. It was never the intention to go to market at the expiry of the initial term.
2. While the initial term was optimal commercially for a SaaS solution, there is a mismatch between the contract terms and the useful life of the asset.
3. Going to market now would require a significant investment in time for the business to go to market and implement a new solution.
4. A change of supplier would cause significant disruption to the business, distracting it from other government priorities.
5. It would also require significant change from the business to bed in a new Evidence Management solution and learn what operational and support capabilities are required to effectively run the solution.
6. A change of supplier would have a significant cost to implement and migrate a large amount of evidence data.
The business being satisfied with the current service levels and solution on offer. EDT has been a very good and reliable supplier of this service and based on pricing and current service meeting our existing and strategic needs, we do not envisage a go to market requirement.
